Heard learned counsel for the petitioner, learned counsel for the respondents and perused the material on record.
It is contended by learned counsel for the petitioner that notice of provisional assessment was issued on 11.1.2019 demanding electricity dues including the compounding charges but without considering the objection of the petitioner, which was stated to have been filed on 18.1.2019, final assessment has been passed by the respondents.
Mr A. K. Saxena, learned counsel for the respondents has not disputed the aforesaid facts and submitted that the objection of the petitioner pending with the department shall be considered and decided in accordance with law within a period of 15 days from today and thereafter consequential order shall be passed in the matter.
Considering the facts and circumstances of the case and also keeping in view the statement of the learned counsel for the respondents, but without prejudice to the merits of the case, the writ petition is finally disposed off with direction to the respondents to consider and decide the objection of the petitioner, pending before it, within a period of 15 days from today in accordance with law. For a period of 15 days, no coercive action shall be taken against the petitioner.
Copy of this order be provided to Mr A. K. Saxena, learned counsel for the respondents for compliance of the order forthwith.
