This application u/s 482 Cr.P.C. has been filed seeking direction to the court below to decide the case no.(708/2006) 936 of 2017 (State vs. Mohd.Rasheed Khan and others), under Section 498A, 323, 504 I.P.C.& 3/4 Dowry Prohibition Act, P.S. Fatehganj East, District- Bareilly, expeditiously.
Heard learned counsel for the applicant and the learned AGA appearing for the State.
It is contended by the learned counsel for the applicant that the applicant is complainant in the aforesaid Case No.708 of 2006 and the case is pending since 01.07.2006. P.W.-5 has been examined on 06.08.2014, thereafter repeated adjournments are being taken on behalf of the accused persons on one or other grounds.
Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the parties, the concerned Court below is directed to decide the aforesaid case expeditiously, preferably within a period of six months fixing short dates, if there is no legal impediment. It is further directed that the parties shall cooperate in the proceeding and no unnecessary adjournment will be sought/granted.
With the above observations, the application stands disposed of.
