JUDGMENT / ORDER

This Contempt Petition has been filed by the Petitioner complaining that the order passed by this Court W.P(MD)No.13582 of 2013, dated 28.1.2014 has been disobeyed.
2.Upon hearing both sides and on perual of the materials placed before this Court, this Court has passed the following order:
It is not in dispute that Anna University has issued mark-sheet for the second semester and sixth semester provisional and degree certificate of M.E. Part-time(Computer Science and Engineering Course) 2009-2012 batch. The Petitioner submitted that Writ Appeal was filed against the order of the learned Single Judge and it was withdrawn and that no mark sheet has been furnished for more than two years, since the date of order of the learned Single Judge.
3.The respondent has produced a typed-set of papers containing documents and contended that the Petitioner has not filed any data based technology and she has been asked to re-appear and the letter obtained from the Dean is fabricated and the Dean is facing criminal proceedings and is under suspension, as he has involved in a scam. This Court directed the respondent to produce the mark-sheet obtained by the Petitioner, which though they have produced and according to the respondent, the mark-sheet produced by the Petitioner is not genuine one and fabricated one obtained from the Dean and that the Dean has no locus to issue the mark-sheet. The Petitioner would submit that the mark-sheet has been issued by Chennai and not from Trichy, where she study for which the Dean is facing scam and the entire records have been forwarded to Anna University, Chennai and has started issuing the mark-sheet. Knowing that the Dean has played fraud, the Petitioner could have easily appear for the examination and clear the remaining one paper inspite of litigating, without realizing the fraud played by the Dean. Since the mark-sheet has been produced by the respondent and that according to Anna University, the Petitioner has not cleared the examination, directs the respondent to furnish the original mark-sheet of the Petitioner as shown in the typed set of papers filed on 8.6.2015, to the Petitioner and hence it is open to the Petitioner to take up the examination for the remaining one paper in which she failed, if so advised.
4.In view of the above, the Contempt Petition is closed.
