Counsel for the petitioners submitted that the partnership agreement between the parties contained an arbitration clause. In fact, Advocate Shri Virendra K. Bhatt was appointed as a sole arbitrator by joint consent of both sides. However, soon after the arbitration proceedings commenced, the respondent issued a communication indicating no trust in the said arbitrator, whereupon Shri Virendra K. Bhatt withdrew himself from the arbitration proceedings. It is, therefore, now necessary to appoint an arbitrator to resolve the disputes between the parties.
