Mr. HK Patel, learned APP waives notice of rule.
Present application has been preferred by the applicant convict for temporary bail on the ground that he wants to take repairing of the house. Pursuant to the earlier order passed by this Court, learned APP states under the instructions from the Police Superintendent of Porbandar that the repairing is required. Jail report shows that earlier, the convict was released and he has surrendered in time.
Under the circumstances, applicant be released on temporary bail for a period of two weeks from the date of his actual release on personal bond of Rs.5000.00 (Rs. Five thousand only) and one surety of the like amount with further direction that upon expiry of the period, he shall surrender to the jail authority. The application is allowed to the aforesaid extent. Rule is made absolute.
