Heard learned counsel for the petitioners and perused the record.
By means of this petition filed under Article 227 of the Constitution, the petitioners have challenged the order dated 10th July, 2021 passed by Civil Judge (J.D.) Naugarh, Siddharth Nagar in Misc. Suit No.- 50 of 2015 (Awadhu and others vs. Pasuram and others), whereby the suit was dismissed for want of prosecution under Order 9 Rule 4 of the Code of Civil Procedure, 1908.
In the considered opinion of the Court, the petitioner has alternative remedy to approach the court sitting in revision against the order passed under Order 9 Rule 4 of the Code of Civil Procedure, 1908.
With the aforesaid liberty, the petition is consigned to records.
