Heard learned Counsel for the petitioner; Shri Ajay Kumar Sharma, learned counsel appearing for the respondent no.
3 and learned Standing Counsel appearing for the State- respondents.
By means of this writ petition the petitioner has come up to this Court stating that pursuant to an advertisement dated 19.1.2017, degree of Diploma in Education (Special Education) (D.Ed.) be also considered for appointment of primary teachers to teach Class 1 to 5 in institution maintained by the Basic Education Board.
It is submitted that the petitioner does not have B.T.C. training, but has D.Ed, which has been prescribed as one of the qualification by the NCTE by order dated 23.8.2010 and amended by orders dated 29.7.2011 and 28.11.2014.
Similar controversy was raised by some other candidates, who have D.Ed. degree instead of B.T.C. and this Court by a detailed judgment dated 5th February, 2014 in Special Appeal defective No.130 of 2014 connected with Special Appeal No.131 of 2014 issued a direction to the respondents to consider the claim of the appellants, who were otherwise qualified for appearing in the selection and have D.Ed. degree instead of B.T.C. training, as has been prescribed by the NCTE be allowed and directed the State Government to consider their claim also for selection.
Learned counsel appearing for the respondent no.3 does not dispute the aforesaid fact.
As such, in my view, in the present case, petitioner is also entitled to the benefit of the judgment of this Court dated 5th February, 2014 passed in the aforesaid Special Appeal defective No.130 of 2014 connected with Special Appeal No.131 of 2014.
The writ petition is, accordingly, disposed of in terms of the aforesaid judgments.
