Heard counsel for the petitioner as well as the Standing Counsel representing respondent no. 1 to 6 and Sri Ashutosh Kumar Singh, counsel for respondent no. 7.
The present writ petition has been filed against the order dated 20.8.2018 passed by the Additional District Judge/Special Judge (E.C. Act and Electricity Act), District Ghazipur in Panchayat Raj Revision No. 02 of 2016 whereby the revisional court has set-aside the judgment and order dated 2.11.2016 passed by the Election Tribunal in Election Petition No. T2016142902344 and remanded back the matter to the Tribunal to pass fresh orders deciding issue no. 5 after giving the parties an opportunity of hearing. The order dated 20.8.2018 passed by the revisional court is supported by reasons and is a remand order.
In view of the aforesaid, it is not a fit case for interference under Article 226 of the Constitution of India..
The writ petition is dismissed.
