Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent and Shri R.B. Yadav, learned counsel for the Gaon Sabha.
Petitioner is before this Court assailing the validity of order dated 15.03.2013 passed by Collector/District Magistrate, Mirzapur in Case no.126 of 2012 (State vs. Paras Nath) by which the fishery patta dated 11.11.201 issued in favour of petitioner in respect of Arazai no.154 area 0.506 hectare (Pond) has been cancelled and impugned order dated 29.06.2017 passed by the Commissioner, Vindhyachal Region, Mirzapur in Revision no.C-2014160000142 of 2013 (Paras Nath vs. State of U.P. and others) under Section 333 of UPZA&LR Act.
After perusing the record in question and considering the entire facts and circumstances of the case, once the Court has declined to interfere in the orders impugned, then in such a situation, learned counsel for the petitioner has requested that the security amount, which has been deposited by the petitioner in pursuance to the fishing rights, the same may be returned to him by the Authority concerned forthwith.
Learned Standing Counsel and Shri R.B. Yadav, Advocate submit that for return of the said amount, in case petitioner moves a proper application before the Authority concerned, the same shall be considered and decided at the earliest strictly as per law.
In view of the above, this Court proceeds to ask the petitioner to move an appropriate application before the Sub Divisional Magistrate, Chunar, District Mirzapur and in case any such application is moved within the period of three weeks from today, this Court hopes and trust that the same would be decided by the Authority concerned in accordance with law expeditiously.
With these observations, the Writ Petition is disposed of.
