As the cause title of the petition declares and even the subject matter of the petition as contained in the memo of petition and as the relief prayed for by the petitioner also disclose, the petition is not related and/or it does not arise from the Gujarat Public Works Contracts Disputes Arbitration Tribunal Act, 1992. Learned counsel for the petitioner has submitted that the arbitration proceedings were not conducted in light of the provisions under the said Act and were not adjudicated before the Arbitration Tribunal under the said Act and the matter does not relate to and/or arise under the said Act. Learned counsel for the petitioner has also submitted that the matter arises from contract and aforesaid Act of 1992 and not and/or Arbitration and Conciliation Act, 1996. Therefore, the office is requested to examine the matter as to whether it pertains to subject assigned to this Court or not.
