Grievance in the writ petition is with regard to non-registration of sale deed dated 21.10.2021, presented by petitioners for registration, before the Sub-Registrar, Mawana, District Meerut.
Taking cognizance of petitioners' grievance we called upon the State Counsel to obtain instructions in the matter.
Written instructions have been received from the Sub-Registrar, as per which neither online application for registration has been made nor the document has been presented before the Sub- Registrar, and therefore there is no occasion to deny registration of document. In para 9 of the instructions it is stated that if the parties appear and present their document for registration, the Sub-Registrar shall undertake necessary action as per law. Copy of the instructions has also been furnished to the counsel for petitioners.
In view of the stand taken by third respondent, we dispose off this writ petition permitting the petitioners to present the sale deed for registration alongwith the parties to the transaction before respondent no.3, alongwith a certified copy of this order, and in case the document alongwith the parties to the transaction are presented, it goes without saying that the Sub- Registrar shall examine the same and shall take necessary action as per law, forthwith.
