1. Heard Sri Amitabh Agarwal, learned counsel for petitioner and learned Standing Counsel for State.
2. Petitioner, Fair Price Licence Holder/Dealer for distribution of essential food items, has filed this petition seeking following relief:
"To issue writ of mandamus commanding the appropriate agency preferably Central Bureau of Investigation to carry out thorough investigation with regard to supply of food grain from the Food Controller to the ultimate consumer and to submit its report before this Hon'ble Court in accordance with law to take adequate measures to carve adequate measures to cure discrepancy in supply of food grains to the Fair Price Distributor and ultimate consumers."
3. When questioned, as to whether petitioner had lodged first information report, if according to him any criminal activities are committed, learned counsel for petitioner could give no reply.
4. Since petitioner has remedy of initiating criminal proceeding against concerned officials, mandamus as prayed for in this petition, cannot be granted.
5. In view thereof, this writ petition is dismissed.
