None has appeared on behalf of the appellant to address the Court, even in the revised call. However, learned AGA is present for the State.
The report of the Chief Judicial Magistrate, Shahjahanpur, dated 2.2.2019, in compliance of the order dated 24.1.2019, is on record indicating that the sole appellant- Pappu had expired in 2016. The enquiry was conducted with respect to the death of the appellant- Pappu as per the circular of this Court. Hence on account of death of above mentioned appellant, the appeal has lost its efficacy.
Accordingly, the appeal on behalf of the appellant- Pappu stands abated.
Let the appeal be consigned to record.
