Heard learned counsel for the petitioners and learned Standing Counsel. Shri Kaushalendra Nath Singh appears for respondent nos.2 and 3.
Learned counsel for the petitioners states that the second petitioner had died and as such his name may be deleted from the array of parties.
The request made is accepted. The name of second petitioner is deleted from the array of parties.
Petitioner has filed the present writ petition claiming that he is working as contract employee, but, he is being discriminated with the regular employees.
Learned counsel for petitioner submits that the case of the petitioner is covered with a large number of decisions of the Apex Court including the case of State of Punjab And Others Versus Jagjit Singh and Others, (2017),1 Supreme Court Cases 148.
Learned counsel for petitioner further submits that grievance of petitioner would be sufficiently met in case representation of petitioner is decided by respondent no. 2 in a time bound manner.
In view of aforesaid and without entering into merits of the case, petitioner is permitted to make a fresh representation to Respondent no. 2, i.e. Managing Director, Paschimanchal Vidyut Vitran Nigam Ltd., Victoria Park-Meerut alongwith copy of this order within a period of three weeks from today relating to his grievance. In case, such a representation is made by petitioner, respondent no. 2, shall consider the same and pass appropriate orders thereon in accordance with law also taking into consideration the law laid down by Hon'ble Supreme Court in the case of State of Punjab and Others Versus Jagjit Singh and Others (Supra) within a period of three months from the date a copy of this order is placed before him.
With the aforesaid, writ petition is disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
