PRAYING TO ENLARGE THE PETITIONER ON BAIL IN CRIME NO.83/2018 OF SESHADRIPURAM POLICE STATION, BENGALURU CITY REGISTERED FOR THE OFFENCE PUNISHABLE UNDER SECTIONS 427, 307, 504 AND 506 OF IPC.
THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Respondent police have charge sheeted the petitioner in Crime No.83/2018 of Seshadripuram police station on the allegation that in a drunken state he attempted to commit murder of his wife and children by releasing the cooking gas in his house.
2. Now the charge sheet is filed. The petitioner is arrested on 22.04.2019. Since then he is in judicial custody. The offences alleged are not exclusively punishable with death or imprisonment for life.
3. As per the charge sheet papers, the alleged act was committed under intoxication. Therefore, the motive has to be decided on full fledged trial. Under such circumstances, it is a fit case to grant bail.
The petition is allowed. Petitioner is granted bail in Crime No.83/2018 of Seshadripuram Police Station, Bengaluru subject to the following conditions:
i) Petitioner shall execute personal bond in a sum of Rs.50,000/-(Rupees Fifty Thousand only) with two sureties in the like sum to the satisfaction of the trial Court;
ii) He shall not tamper the prosecution witnesses; & iii) He shall appear before the jurisdictional Court as and when required.
