Heard Shri Prashant Vardhan, learned counsel for the petitioner and Shri Wasim Masood, learned counsel for the respondent no.3.
The petitioner has filed an appeal along with the stay application before the U.P. Real Estate Regulatory Authority against the impugned demand. This fact is not denied by the respondents.
Learned Counsel for the respondent no.3 states that the petitioner has also filed an application under Section 5 of Limitation Act along with the appeal for condonation of delay as the appeal has not been filed within time as prescribed under the Act.
Learned Counsel for the petitioner states that there is a short delay in filing the appeal, which may be condoned by this Court.
Considering the facts and circumstances as stated above, the delay, if any, in filing the appeal is condoned by this Court. The appeal may be treated to have been filed within time.
The orders may be passed on the stay application filed by the petitioner within next ten days.
Till orders are being passed on the stay application, no coercive action may be taken against the petitioner.
The writ petition is accordingly disposed of.
A copy of the order may be given to Shri Wasim Masood, learned counsel for the respondent no.3 within next 24 hours for communication and necessary compliance.
