Case has been called out. No one has appeared on behalf of the revisionist to press the revision. Learned A.G.A. is present on behalf of the State.
The instant revision has been filed against the judgment and order dated 11.02.1994 passed by the Third Additional Sessions Judge, Allahabad whereby he has upheld the conviction of the appellants under Section 323 read with Section 34 I.P.C. made vide order dated 18.07.1992 passed by the ACJM-IV, Allahabad in Case No.1167 of 1990 (State Vs. Panchu and others) but has granted the benefit of U.P. Probation Act to the appellants and have released the appellants on probation upon personal bond of Rs.2,000/- and undertaking to maintain peace and good behaviour for a period of one year.
The revisionists were the appellants in the court below.
No interim order was passed while entertaining the revision. I have perused the record.
A perusal of the record would reveal that the prosecution case was established by ocular evidence and there were injured witnesses also in support of the prosecution case and the injuries were proved by Dr. Harish Chandra. The courts below have returned well discussed findings in respect of guilt of the revisionists for the offences for which they have been convicted.
Under the circumstances, the judgment and order of the court below does not suffer from any legal infirmity which may warrant interference in exercise of revisional powers. The revision is, accordingly, dismissed.
