JUDGMENT / ORDER

1. This petition under Article-226 of the Constitution of India has been preferred, with the following prayers :
"a) To admit this petition.
b) To allow this petition by issuing writ of certiorari or any other appropriate writ, order or direction, by directing the respondents to consider the case of petitioner by accepting the remaining amount of Sale Auction with reasonable simple interest on such amount and may further direct to respondents to hand over all necessary papers of title of plot no.25 of Ward No.13 of Shashtrinagar area, admeasuring 200.93 sq.mtrs. of Rajkot and hand over the possession of the plot to petitioner.
c) Pending admission, hearing and final disposal of this petition, to grant interim relief by directing the respondents to maintain status quo regarding the plot no.25 of Ward No.13, Shastrinagar Area Rajkot admeasuring 200/93 sq. mtrs. and also directing respondent not to take any coercive action regarding above mentioned plot;
d) to pass such other and further reliefs that may be deemed fit and proper in the facts and circumstances of the case, be granted, in the interest of justice."
2. Earlier the petitioner had filed a petition being Special Civil Application No.13972/2011 that was withdrawn, with a view to making a representation to the concerned Authority. It is the case of the petitioner that the representations made by the petitioner have not been responded to by the Commissioner, Rajkot Municipal Corporation.
3. Mr.K.J.Kakkad, learned advocate for the petitioner states that the interest of justice would be met, if the Commissioner, Rajkot Municipal Corporation (Respondent No.1), is directed to consider and decide the representation dated 13.04.2012 (Annexure-H), made by the petitioner within a time-bound period.
4. In view of the above statement made by the learned advocate for the petitioner, the following order is passed :
The Commissioner, Rajkot Municipal Corporation (Respondent No.1), may consider and decide the representation dated 13.04.2012 made by the petitioner, in accordance with law, as expeditiously as possible, but not later than a period of four months from the date of receipt of a copy of this order.
The petition is disposed of, in the above terms, without entering into the merits of the case.
Direct service of this order is permitted.
