JUDGMENT / ORDER

This Criminal Original Petition has been filed to call for the records relating to FIR No.5 of 2017 pending on the file of the first respondent police and quash the same.
2. Today, both the petitioner /accused and the second respondent / defacto complainant along with their respective learned counsel on record are present. The learned Additional Public Prosecutor appearing for the first respondent is present. The identities of the parties have been verified. They have submitted that the dispute between them has been amicably settled. They have also filed a Memorandum of Agreement dated 31.05.2017 signed by both the parties to that effect. When this Court enquired the parties, particularly, second respondent / defacto complainant, about the factum of agreement and the terms of the agreement, she admitted the same. She also filed a consent affidavit dated 09.06.2017, for quashing the FIR in Crime No.5/2017 registered against the petitioner herein.
3. In view of the above, this Criminal Original Petition is allowed and the FIR in Crime No.5 of 2017 pending on the file of the first respondent is quashed. The Memorandum of Agreement dated 31.05.2017 signed by both the parties and the consent affidavit of the second respondent / defacto complainant dated 09.06.2017 are taken on record.
