JUDGMENT / ORDER

The prayer made in the writ petition is to issue a writ of Mandamus directing the respondent to grant permission and police protection to conduct “Gramiya Kalai Nigazhchi” scheduled to be held on 10.03.2017 on the eve of Sri Mandai Mariyamman Temple festival situated at Athirampatti, Omalur Taluk, Salem District based on the petitioner's representation dated 05.03.2017.

It is the grievance of the petitioner that he has submitted a representation dated 05.03.2017 to the respondent, seeking permission to conduct “Gramiya Kalai Nigazhchi” in the event of Sri Mandai Mariyamman Temple festival scheduled to be held on 10.03.2017. However, till date, no order has been passed by the respondent. Hence, this petition.
3. Though the petitioner sought for permission to conduct “Gramiya Kalai Nigazhchi”, learned counsel for the petitioner restricted the same to the extent of conducting Orchestra, for which, the learned Additional Public Prosecutor appearing for the respondent has raised no serious objection.
4. In view of the submission so made by the learned counsel for the petitioner, the respondent is directed to consider the representation of the petitioner dated 05.03.2017 and grant permission to the petitioner to conduct Orchestra in the event of Sri Mandai Mariyamman Temple Festival situated at Athirampatti, Omalur Taluk, Salem District, scheduled to be held on 10.03.2017, subject to usual conditions. It is made clear that this Court has not granted any direction to conduct “Adal Padal Nigazhchi / dance programme” in the name of “Gramiya Kalai Nigazhchi”.
5. The writ petition is disposed of accordingly.
