This writ petition is filed seeking a declaration that Form 5-A notice issued under the Land Acquisition Act (for short ‘the Act’) by the 1st respondent dated 01.10.2009 proposing to take possession after expiry of 15 days is arbitrary and illegal.
Learned Government Pleader for Land Acquisition under instructions stated that as the urgency clause was not invoked, a notice under Section 5-A of the Act was issued and the petitioners had submitted their objections on 10.02.2010 and there after, a declaration under Section 6 of the Act was also published.
In the circumstances, no further enquiry is necessary and the Writ Petition is accordingly disposed of. No costs.
