BELOW NOTE FOR SPEAKING TO MINUTES This matter has come up on the note for speaking to minutes of order dated 9.4.2012 passed by this Court in First Appeal No.3318 of 2005.
Mr Parikh, learned counsel for the appellant submitted that though the appeal was allowed by this Court, inadvertently, in the operative part of the judgment it has been mentioned/typed as 'Therefore, the present appeal is dismissed" and it should be read as "Therefore, the present appeal is allowed."
The submission of learned counsel for the appellant is accepted. The word 'dismissed' appearing in paragraph 5 of the order dated 9.4.2012 shall be read as 'allowed'.
Note for speaking to minutes is disposed of accordingly.
