Oriental vs Arjunbhai

Since the award is under section 140 of the M.V. Act, and in view of the averments made in the application, the delay caused in filing the first appeal is required to be condoned. Accordingly, delay is condoned. Civil application stands allowed accordingly. First appeal may come up for hearing as to admission on 16th January 2012. Rule is made absolute accordingly.
