Heard learned counsel for the petitioner, learned A.G.A. for the respondent Nos. 1 & 2 and perused the record.
The instant petition seeks quashing of the First Information Report dated 5.11.2019, registered as Case Crime No. 0290 of 2019, under Sections 363, 366 I.P.C. at Police Station- G.R.P. Aligarh Junction, District -Aligarh.
The allegation in the impugned First Information Report is that informant's daughter- Deepika, aged about 15 years, has gone missing from the Railway Station on 3.11.2019. Suspicion has been expressed against the petitioner and one Ravindra Singh along with two other unknown persons.
The contention of the learned counsel for the petitioner is that the petitioner is innocent and has no connection with the daughter of the informant and, therefore, the First Information Report against the petitioner is misconceived.
Be that as it may, as a person is missing and suspicion has been expressed against the petitioner, the matter would have to be investigated and all possible steps would have to be taken to ensure recovery of the missing person.
Hence, the prayer of the petitioner that the F.I.R. be quashed or no action be taken against the petitioner cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail or anticipatory bail as may be advised.
