Order on Crl. Misc. Modification Application Learned counsel for the parties are present.
Learned counsel for the appellants submitted that though the appellant nos. 1, 2 and 4 have been granted bail vide order dated 22.10.2018 directing the appellants to be released on bail on their furnishing a personal bond and two heavy sureties (one should be of their family member) but since the appellants do not have any such family member available who may file two heavy sureties, hence it is prayed that in place two heavy sureties of family members, they should be allowed on bail on furnishing two heavy sureties of relative.
The said order is modified as follows:-
Learned counsel for the appellant nos. 1, 2 and 4 convicted and sentenced in S.T. No. 314 of 2015 (State Vs. Omkar and others), arising out of Case Crime No. 89 of 2015. under Section 302 read with Section 34 IPC, P.S. Bhot, District Rampur be released on bail on their furnishing a personal bond with two heavy sureties (one should be of their relatives) each in the like amount to the satisfaction of the court concerned.
Accordingly, the modification application is disposed of.
