Heard learned counsel for the petitioners and the learned Standing Counsel.
Present petition has been filed for quashing the order dated 7.12.2020, passed by Respondent no.3 / Sub- Divisional Magistrate, Kasimabad, District- Ghazipur as well as for directing the Respondent-Authority to allot the Fair Price shop in favour of the petitioners.
After some argument, learned counsel for the petitioners admits that he has statutory remedy by way of filing an appeal. He, however, submits that some delay has taken place in filing the appeal.
In such view of the matter, the petition is disposed of with the direction that in case, the petitioners prefer an appeal before the Authority concerned within 3 weeks from today, same shall be considered without taking any objection regarding limitation and the same may be decided as expeditiously as possible, preferably within 2 months from the date of production of self-attested copy of this order, which may be verified from the official website of the Allahabad High Court.
With the aforesaid observations, the writ petition is disposed of.
