Petitioners are resident of Village Nagla Danda, Mazra Dhubai, Pargana and Tehsil Sikandra Rau, District Hathras. Proclamation under Section 4 of the Forest Act, 1927 was issued in respect of the land and the surrounding area where their residential accommodation is situated. On 10.11.1955 proclamation under Section 6 of the Act was issued. On 22.02.2008 all the petitioners are alleged to have filed objections under Section 6(C) of the Act in the year 2009 itself on different dates, which have been registered as Case No. 425/2009, 281/2009, 426/2009, 290-B/2009, 425-B/2009 & 292/2009 before the Forest Settlement Officer, Mahamaya Nagar, Hathras, respondent no. 2.
Grievance of the petitioners is that till date the said objections are pending and without taking any decision in the matter efforts are being made to forcibly evict them.
Considering the facts and circumstances of the case, we dispose of the writ petition by directing the respondent no. 2 to consider and decide the aforesaid objections filed by the petitioners in accordance with law after notice and opportunity of hearing to all concerned by a reasoned and speaking order within a period of two months from the date of production of certified copy of this order before him.
For a period of two months or till the disposal of the objections of the petitioners, whichever is earlier, all coercive action including ejectment of the petitioners over the land in question shall remain stayed.
