Heard learned counsel for the petitioner.
The present writ petition has been filed by the petitioner seeking following relief:
"(i) An order or direction to decide the Civil Suit No. 2 of 2018 (NCR No. UPMO03000447/2020) New No. 243 of 2020 (Om Prakash Singh Vs. Tara Singh) pending in the Court of the Judge, Small Causes Court, Muradabad within a specific period or day by day hearing in the interest of justice."
It is contended that the petitioner filed the aforesaid suit against the respondent for eviction and arrears of rent. In the said suit issues have been framed on 08.03.2019 and thereafter the matter is pending consideration before the Court concerned.
I have perused the order-sheet.
Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it expeditiously.
Having regard to the facts and circumstances of the case, but without entering into merits of the case, the writ petition is disposed of with a direction to the Court concerned to make all possible efforts to decide the aforesaid case in accordance with law expeditiously, fixing short dates, without granting any unnecessary adjournment to either of the parties, provided there is no legal impediment.
