Heard learned counsel for the petitioner and Shri Abhishek Srivastava, learned Addl. Chief Standing Counsel. Shri Diwakar Singh appears for Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to second respondent to take necessary action in the matter pending before him, ensuring removal of illegal construction made on the way by private respondents. It is contended that in this regard the petitioner has also moved representation before the second respondent on 22.2.2018 on which cognizance has been taken and the report has also been asked for but no final order has been passed in the matter and as such this Court should come for rescue and reprieve of the petitioner.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the second respondent to look into the grievance of the petitioner and pass appropriate order in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned.
