Heard learned counsel for the petitioner and the learned A.G.A.
This writ petition has been filed praying for the following reliefs:
"i) issue a writ, order or direction in the nature of certiorari quashing the First Information Report dated 06.07.2021 in Case Crime No. 0338 of 2021, under Section 3(1) U.P. Gangsters Act and Anti Social Activities (Prevention), Act, 1986, Police Station-Khorabar, District-Gorakhpur.
ii) issue a writ, order or direction in the nature of mandamus directing to the respondents not to arrest the petitioner in Case Crime No. 0338 of 2021, under Section 3(1) U.P. Gangsters Act and Anti Social Activities (Prevention), Act, 1986, Police Station-Khorabar, District-Gorakhpur."
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner want to withdraw the writ petition with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is disposed off with liberty to the petitioner to apply for regular bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners along with a self attested identity proof of the said persons (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
