Order on Modification Application No. 01 of 2021.
The instant modification application has been filed for modifying the order dated 03.09.2021 passed by this Court.
Learned counsel for the applicants submits that while passing the order dated 03.09.2021, no coercive action shall be taken against the applicants, has been granted but the same could not be transcribed in the order dated 03.09.2021 and prays to modify the order to the aforesaid extent.
In view of above, the modification application is allowed.
The order dated 03.09.2021 is modified to the extent that the following paragraph shall be read after paragraph no.3 of the order dated 03.09.2021.
"Till the next date of listing, no coercive action shall be taken against the applicants in Complaint Case No. 138 of 2019 (Rahul Prakash Vs. Om Prakash Gupta and another), arising out of Case Crime No. 867 of 2018 under Section 392 I.P.C, Police Station Kotwali, Orai, District Jalaun pending before learned Additional Sessions Judge/Special Judge (Dacoity Affected Area), Jalaun at Orai".
