Petitioner is before this Court with a request commanding the first respondent to pay the Gratuity, Leave Encashment and Pension arrear (August 2020 to December 2020) of the petitioner along with interest within stipulated period.
Learned counsel for the petitioner submits that the petitioner has retired as Assistant Engineer (Civil) from the office of the respondent no. 3 on 31.7.2020 after attaining the age of superannuation but till date the aforesaid retiral benefits has not been extended to him.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally directing the competent authority to decide the claim of the petitioner strictly in accordance with law and ensure payment of entire admissible amount within a period of two months from the date of production of a copy of this order, failing which, the petitioner would also be entitled for 8% interest on delayed payment.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
