JUDGMENT / ORDER

(Per : MR.JUSTICE D.H.WAGHELA) Even while learned counsel Mr.C.M.Gandhi is present for respondent No.1 and none of the respondents are personally present in compliance with the previous order dated 13.02.2012, learned counsel for applicant, the company in liquidation, is not present. However, Mr.A.K.Chaturvedi, the Official Liquidator representing the applicant, has tendered a copy of letter dated 28.9.2012, which is addressed to the Hon'ble Chief Justice and signed by respondent No.1 and his advocate Mr.M.B.Gandhi. It could not be easily understood as to why the Official Liquidator should place on record the letter written by respondent No.1 to the Hon'ble Chief Justice and then apologize, while respondent No.1 is duly represented and the application for initiating action against the respondents under the Contempt of Courts Act is admitted as early as on 13.02.2012.
2. Under the circumstances and in view of absence of the respondents, office is directed to issue bailable warrants in the sum of Rs.10,000/- each for ensuring personal presence of the respondents on 22.10.2012. The aforesaid letter dated 28.09.2012 is taken on record and ordered to be kept in safe custody in the Registry. Photocopy of the letter dated 28.09.2012 shall be placed on record of both the sets and may be considered for appropriate order in that regard on the next date of hearing. S.O. to 22.10.2012.
