Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus directing the respondent no.2 (Sub Divisional Magistrate, Handia, Allahabad) to decide the case no.176 of 2012 (Mohd. Ayub Ansari Vs. Gaon Sabha) under Section 41 L.R. Act, within stipulated period, which may be fixed by this Hon'ble Court."
The petitioner is aggrieved because his application for demarcation under Section 41 of the U.P. Land Revenue Act filed in the year 2012 has not been decided finally till date.
Under the circumstances, this writ petition is disposed of directing the respondent no.2 (Sub Divisional Magistrate, Handia, Allahabad) to endeavour to decide the case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
