This application U/S 482 Cr.P.C. has been filed seeking quashing of the charge sheet dated 31.12.2014, the cognizance order dated 7.5.2015 passed by the Addl. Chief Judicial Magistrate, Ist, Aligarh as well as entire proceeding of Criminal Case No. 522 of 2015, arising out of Case Crime No. 249 of 2014, State versus Nurudeen and others, under Sections 452 and 324 IPC, P.S. Kotwali Nagar, District Aligarh pending in the court of Addl. Chief Judicial Magistrate, Ist, Aligarh.
Heard learned counsel for the applicants, learned AGA and perused the record.
Learned counsel for the applicants has been fair enough to admit that the trial has already commenced and two prosecution witnesses have also been examined. In such circumstances, this Court has serious doubt about the appropriateness of moving this application. Inherent jurisdiction of this Court is not meant to hijack the regular statutory course and scuttle the same.
The application, therefore, stands dismissed.
