N.Thirumoorthy vs The Special Officer

Madras High Court|25 April, 2012

JUDGMENT / ORDER

The impugned order is passed by the respondent, a Co-operative Society. The impugned order is an order placing the petitioner under suspension. It is well-settled law that Writ Petition is not maintainable against the Cooperative societies. At this juncture, the learned counsel for the petitioner states that the petitioner has filed a revision under Section 153 of the Tamil Nadu Co- operative Societies (hereinafter called as the 'Act') before the Joint Registrar of Co-operative societies, Tirunelveli, but the same was rejected by order, dated 16.08.2010 stating that revision under Section 153 of the 'Act' could not lie against an order of suspension. However, the petitioner has not chosen to challenge the aforesaid order, dated 16.08.2010 of the Joint Registrar of Co- operative Societies, Tirunelveli and the Joint Registrar of Cooperative Societies is not a party to the Writ Petition.
2. Hence, this Writ Petition is dismissed. However, it is open to the petitioner to question the order of the Joint Registrar of Co-operative Societies, Tirunelveli, dated 16.08.2010 referred to above, if he is so advised. Consequently, connected Miscellaneous Petitions are dismissed. No costs.
vsn To The Special Officer, E.E.255, Ramasamiyapuram Primary Agricultural Cooperative Credit Society, Sivagiri Taluk, Tirunelveli.
