Heard Sri S.S. Pandey, learned counsel for the applicant, Sri Irshad Hussain, learned A.G.A. appearing for the State and perused the record.
Mohd. Akbar Shah Alam Khan, learned counsel for the complainant is not present though the matter has been called in the revised list.
The first two bail applications of the applicant have been rejected by this Court vide order dated 15.4.2015 and 10.8.2017 respectively.
From the perusal of the order passed on aforesaid dates, it is clear that the trial was expedited while rejecting the bail applications of the applicant.
It has been contended by the learned counsel for the applicant that five prosecution witnesses have been examined out of which four have turned hostile. The applicant is in jail since 17.9.2014.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Noli @ Naim involved in Case Crime No. 333 of 2014 under Sections 147, 148, 149, 307, 302 I.P.C., police station Chhapar, District Muzaffar Nagar.
Accordingly, the bail application is rejected.
However, the trial court is directed to further expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
