By means of this writ petition, the petitioner has made a prayer that respondent No.2 has raised certain illegal construction and has obstructed a public pathway and, therefore, a complaint to the respondent No.1 has been made under U.P.Regulation of Building Act, 1958. It is submitted that under section 10 of the Act, the authority has the power to interfere and pass appropriate order with regard to the demolition. It is submitted that the petitioner has filed a complaint being case No. 1 of 2015 which is pending before the authority. Pursuant to such complaint certain reports were called for but further action has been taken.
The writ petition is disposed of with the observation that in case any complaint of the petitioner is pending before the authority, the authority will look into the veracity of the complaint and after due notice to the other party will proceed and decide in accordance with law without unnecessary delay.
