JUDGMENT / ORDER

By an order of this Court dated 01.09.2016, the Transfer Civil Miscellaneous Petition was referred to the Tamil Nadu Mediation and Conciliation Centre, High Court Madras, wherein, an agreement was arrived at between the parties is as follows:-
1) The petitioner and the respondent agreed to settle their dispute before mediation. The respondent agreed to pay a sum of Rs.43,00,000/- (Rupees forty three laksh only) in full quit to the petitioner. The respondent paid Rs.10,00,000/- (Rupees ten lakhs only) on 03.10.2016 vide two D.D.Nos.900093 and 900130 dated 21.09.2016 and 26.09.2016 respectively drawn on Indian Bank at ERA Puram Branch at Vellore in favour of the petitioner Nirmala. The sum of Rs.10,00,000/- (Rupees ten lakhs only) will be paid at the time of mutual consent petition filed before the Family Court, Chennai. The balance amount of Rs.23,00,000/- (Rupees twenty three lakhs only) will be paid on the filing of proof affidavit in the respondent to the petitioner.
2) The petitioner will withdraw F.C.O.P.No.46 of 2016 and FCMC.No.13 of 2016 pending before the Family Court at Vellore.
3) The respondent will withdraw O.P.No.247 of 2016 pending before III Additional Family Court, Chennai.
2. The petitioner and the respondent signed in the Mediation Agreement and counter-signed by their respective counsels.
3. In view of the above Mediation Agreement, the Transfer Civil Miscellaneous Petition is disposed of. It is open to the parties to proceed as per the Mediation Agreement. No costs. Consequently, connected miscellaneous petitions are closed.
