Heard Sri Sachin Kumar Sharma, learned counsel for the petitioner, Sri Sanjay Singh, learned counsel for the respondent- bank and learned Standing counsel.
By means of the present writ petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no. 4 Branch Manager, Punjab National Bank, Branch- Islam Nagar District- Budaun to issue No Dues Certificate to the petitioner within stipulated period as fixed by this Court.
It is contended by learned counsel for the petitioner that pursuant to the order of this Court dated 28.3.2019 passed in Writ-C No. 10292 of 2019, the petitioner has paid entire loan in the installments as fixed by the Court and his last installments was paid on 20.4.2020 but the Bank has not issued No Dues Certificate to the petitioner.
Learned counsel for the bank submits that the grievance of the petitioner may be considered by the bank as the petitioner in this regard had already moved a representation dated 15.6.2020 before the bank which is still pending.
In the facts and circumstances of the case, direction is issued upon respondents-bank to decide the petitioner's representation dated 15.6.2020 expeditiously, preferably within a period of three weeks from the date of production of a certified copy/computerized copy of this order. If the entire amount has been paid by the petitioner, the respondents-bank is directed to issue No Dues Certificate to him immediately.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
