JUDGMENT / ORDER

Shri Vakil, learned advocate appearing for the petitioner has relied upon the interim order passed by this Court in Special Civil Application No. 2974 of 2012 dated 26.03.2012 and submitted that the facts of this matter are better than of that matter.
In the instant case, the notice was issued on 12.5.2011 raising demand of Rs.17 lacs and subsequently, it was reduced to Rs.16 lacs and now it has come down to Rs.12.80 lacs. The petitioner's bauxite worth Rs. 2.7 crore i.e 45 mt. Ton held up on account of non-issuance of Royalty pass books.
In view of this, when it is categorically urged at the bar that this matter is covered by the interim order passed in Special Civil Application No. 2974 of 2012 and that order was brought to the notice of Geologist but it was of no avail, let there be a short notice to afford an opportunity to respondents.
Notice returnable on 20.04.2012. Learned advocate for the petitioner has assured the court that notice to respondents will be served by 16.04.2012. No further time shall be granted. Direct service permitted today.
