Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present 482 Cr.P.C. application has been filed for a suitable direction to the Additional Chief Judicial Magistrate, 5th Allahabad, to decide the Complaint Case No.1491 of 2018 (Nidhi Tiwari vs Vikas Tiwari and others) under Section 12 Domestic Violence Act, Police Station Jhunsi, District-Allahabad, pending in the Court of the Additional Chief Judicial Magistrate 5, Allahabad expeditiously as possible as within short stipulated period.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to the Additional Chief Judicial Magistrate, 5th Allahabad to consider and decide the Complaint Case No.1491 of 2018 (Nidhi Tiwari vs Vikas Tiwari and others) under Section 12 Domestic Violence Act, Police Station Jhunsi, District- Allahabad, most expeditiously, preferably within a period of one year from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
