JUDGMENT / ORDER

Petitioners herein are the accused in C.C. No. 283/2014 of the Chief Judicial Magistrate Court, Thalassery. Crime in the said case was registered on the complaint of one Nithin, that these petitioners assaulted him and his brother in connection with some dispute and inflicted injuries on their body. Crime was registered under Sections 143, 147, 341 and 323 IPC. Now, the accused want to have the prosecution quashed on the ground that they and the injured have settled the dispute amicably out of court. 2. The injured persons, Nithin and Nibil are the 2nd and 3rd respondents in this proceeding. They have filed affidavit to the effect that they have settled the dispute, and that they have no grievance or complaint. Orders are sought under Section 482 Cr.P.C. because some offences are not compoundable. I am well satisfied that the parties have really settled the whole dispute, and continuance of prosecution in such a situation will be a sheer Crl.M.C. No. 5571 Of 2014 2 waste of time.
In the result, this petition is allowed. Prosecution against the petitioners in C.C. No. 283/2014 of the Chief Judicial Magistrate Court, Thalassery, will stand quashed under Section 482 Cr.P.C., and the petitioners will stand released from prosecution. The bail bond, if any, executed by them will stand discharged.
