Heard learned counsel for the applicant.
A writ petition preferred by the applicant challenging a list of transfer was disposed of without interfering with the order impugned therein leaving it open to the applicant to represent her case. On the last occasion, the Court had called upon the learned counsel to file an Affidavit stating whether the applicant had in fact joined the place of transfer or not. Today, the learned counsel for the applicant contends that no question of joining arises since the list as prepared was not acted upon nor were any final orders of transfer passed against the applicant.
Be that as it may, the Court notes from the record that on 29 June 2017 the Basic Education Officer had passed an order wherein he takes the position that in light of the Government Order dated 13 June 2017 a comprehensive exercise for consideration of claims of transfer has been set in motion and that it is open to the applicant to apply online and await a final decision. Consequently, this Court finds no ground to initiate proceedings in contempt.
The petition is dismissed.
