Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in case crime No.22 of 2019, under Sections 302, 201 I.P.C., Police Station Sidhpura, District- Kasganj with the prayer to enlarge him on bail.
For the purposes of evaluating the prayer for bail, the Court notes that the deceased who was eleven years old is stated to have had an altercation with the son of the applicant. The applicant was last seen with the deceased as per the version setforth in the FIR. The evidence of last seen has not been explained by the applicant. Consequently the provisions of Section 106 of the Evidence Act are not satisfied. Bearing in mind the fact that a minor child was done to death, the Court finds no ground to enlarge the applicant on bail.
Consequently, the application is rejected.
