Heard Sri R.K.S. Parmar, learned counsel for the petitioner, Sri Irshad Hussain, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 3.2.2018 registered as case crime no. 62 of 2018 under sections 452, 376, 511 I.P.C., police station Bahedi, District Bareilly.
Learned counsel for the petitioners submits that earlier the petitioner has challenged the impugned F.I.R. by filing Crl. Misc. Writ Petition No. 5473 of 2018 which was dismissed by co-ordinate Bench of this Court vide order dated 7.3.2018. He submits that thereafter the matter has been compromised between the petitioner and respondent no. 3, hence he filed the present second petition praying for quashing of the impugned F.I.R. on the ground of compromise.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we are not inclined to interfere in the matter as earlier the petition filed by the petitioner challenging the impugned F.I.R. has been dismissed by co-ordinate Bench of this Court.
The petition is dismissed on this ground alone.
