Heard learned counsel for the petitioners and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
The petitioner is before this Court for a direction to the Judicial Magistrate-I, Gorakhpur to decide the Case No. 3944 of 2019 (State Vs. Deepak) arising out of Case No. 1190 of 2016 (Smt. Neetu Yadav and Others Vs. Deepak Yadav and Others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Judicial Magistrate-I, Gorakhpur to consider and decide the aforesaid execution case in accordance with law expeditiously and preferably within a period of six months from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
