This is a writ petition against the recovery of loan as arrears of land revenue.
Sri Abhishek Mishra, learned counsel appearing for the respondent-Bank was requested to seek instructions and upon instruction, he submits that the loan was not disbursed under any State sponsored scheme, therefore, the loan cannot be recovered as arrears of land revenue. He further submits that the Bank has taken a decision to get the recovery citation withdrawn.
Upon the statement of Sri Abhishek Mishra, learned counsel for the respondent-Bank that the recovery citation will be withdrawn, no cause of action can be said to now survive.
The writ petition has been rendered infructuous and it is accordingly, dismissed.
