1. While parity has been claimed by the applicant with co- accused Rajesh Nigam, who has been enlarged on bail by this Court, learned counsel for the informant would submit that the applicant is the citizen of Nepal and if enlarged on bail, he is likely to avoid the trial. In that regard, it has been submitted, even at present, the applicant is not cooperating in the trial proceedings inasmuch as cross-examination of PW-2 has been delayed solely by the applicant.
2. In view of the above before the present bail application is decided, it is desirable that a certified copy of the ordersheet of the learned trial court may be produced.
3. List on 02.01.2020, on which date, learned counsel for the informant may bring on record, a certified copy of the ordersheet indicating the conduct being offered by the applicant.
