1. Heard Sri P.K. Singh, learned counsel for the petitioners and learned Standing Counsel for the State.
2. This is a thoroughly misconceived and ill-advised writ petition.
3. The present writ petition has been filed stating that petitioners are already getting another construction and they will shift their training centre to new building, so respondents may be directed not to demolish the building in question.
4. It is nowhere stated in the writ petition that present construction was raised by petitioners after valid compliance of legal requirement of bye-laws of local bodies and after sanctioning of map etc. There is also no averment that the construction is not unauthorized or encroachment.
5. Be that as it may. We cannot pass any such order restraining demolition of building in question since it is nothing but a suit for injunction of alleged demolition though involves several disputed questions of fact, which requires examination after collection of evidence.
6. Writ petition is, accordingly, dismissed.
